Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Zomodus, a product operated by Zomodus Pte Ltd (“Zomodus”, “we”, “us”). By creating an account or using Zomodus, you agree to these Terms. If you are using Zomodus on behalf of an organisation, you confirm you are authorised to bind that organisation.

1. The service

Zomodus lets you build questionnaires, collect responses by link or QR code, and generate reports from those responses. We may add, change or remove features over time to improve the service.

2. Your account

Access uses email magic-link sign-in. You are responsible for keeping access to your email secure and for all activity under your account. Tell us promptly if you believe your account has been accessed without authorisation.

You must provide accurate information and be old enough to form a binding contract under the laws that apply to you.

3. Acceptable use

You agree not to use Zomodus to: break the law or infringe anyone's rights; send spam or collect responses from people without a proper basis; solicit sensitive personal data without consent and a lawful basis; upload malicious code; attempt to disrupt, reverse-engineer or gain unauthorised access to the service; or resell the service without our written agreement.

You are responsible for the content of your surveys and for how you collect and use responses, including obtaining any consents and providing any notices required by law.

4. Credits, plans and payment

Zomodus is sold on a credit model: one response uses one credit. Credits are provided through a free monthly allowance, paid subscription allowances, and pay-as-you-go credit packs. Subscription allowances reset each billing period and do not roll over; purchased credit-pack (top-up) credits do not expire.

Paid plans and card checkout may not be available in every region at all times; where a feature is marked “coming soon,” it is not yet available for purchase. Prices are shown on the pricing page and may change on a prospective basis. Except where required by law, payments are non-refundable, and credits have no cash value.

5. Your content and data

You retain ownership of the surveys you create and the responses you collect (“Your Content”). You grant us a limited licence to host and process Your Content solely to provide the service to you. Our handling of personal data is described in our Privacy Policy.

6. Our intellectual property

Zomodus, including its software, design, and brand, is owned by Zomodus Pte Ltd and its licensors. These Terms do not transfer any of our intellectual property to you beyond the right to use the service as permitted here.

7. Service availability

We aim to keep Zomodus available and reliable, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may suspend access where necessary to protect the service or comply with the law.

8. AI-assisted features and translations

Some features of Zomodus use automated and AI-based processing — including translating your surveys into other languages and analysing open-ended responses. These features are provided “as is.” Automated translations and AI-generated analysis are produced by machine models and may contain errors, omissions or inaccuracies, and we do not warrant that any translation is accurate, complete or fit for a particular purpose.

Where you offer a survey in more than one language, you are responsible for reviewing the translated wording before you rely on it — ideally with a native speaker for any official or high-stakes survey — and you can edit and correct the translations at any time. You remain responsible for the meaning conveyed to your respondents in every language you publish. Respondents are shown a notice that a translation was produced by AI and may contain mistakes.

9. Disclaimers

Zomodus is provided “as is” and “as available.” Reports and analysis are decision-support tools based on the data you collect; they are not professional advice and you remain responsible for decisions you make. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Zomodus will not be liable for indirect, incidental, special or consequential losses, or loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to the service is limited to the amount you paid us for Zomodus in the twelve months before the event giving rise to the claim.

11. Termination

You may stop using Zomodus at any time. We may suspend or terminate access if you breach these Terms or where required to protect the service or comply with the law. On termination, your right to use the service ends; sections that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) will continue to apply.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued use of Zomodus after changes take effect means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising from them, subject to any mandatory rights you may have under applicable law.
